TERMS OF SERVICE

Terms of Service

Effective Date: July 11, 2026

Welcome to Michael Straub Photography. By booking a photography session, purchasing photographic services, or using this website and related services, you agree to the following Terms of Service.

1. Booking Services

Photography services are considered reserved once a signed agreement (when required) and any applicable retainer or payment have been received.

Session dates and times are reserved exclusively for the client once confirmed.

2. Pricing

All pricing is subject to change without notice until a booking has been confirmed.

Quoted pricing will be honored for the agreed-upon booking. Additional services, products, travel, editing, or extended session time may incur additional charges.

3. Payments

Payment terms will be outlined in the booking agreement or invoice.

Invoices not paid by the due date may be subject to late fees or cancellation of services.

Digital images, prints, albums, and other products may not be delivered until payment has been received in full unless otherwise agreed in writing.

4. Cancellations and Rescheduling

Clients should notify Michael Straub Photography as soon as possible if a session needs to be rescheduled.

Outdoor sessions may be rescheduled due to unsafe weather at the photographer’s discretion.

Retainers or reservation fees are generally non-refundable but may be applied toward a rescheduled session when approved.

If Michael Straub Photography must cancel due to illness, emergency, or circumstances beyond reasonable control, every effort will be made to reschedule. If rescheduling is not possible, payments received for undelivered services will be refunded.

5. Photographer’s Artistic Style

Clients acknowledge they have reviewed the photographer’s portfolio and understand that images will reflect Michael Straub Photography’s artistic style, composition, editing techniques, and creative judgment.

Editing requests that substantially alter the photographer’s artistic style may be declined or subject to additional fees.

6. Image Selection and Editing

The photographer will determine which images meet professional standards for delivery.

Not every photograph taken during a session will be delivered.

Basic editing is included unless otherwise specified. Extensive retouching, object removal, body modifications, or other advanced editing may be available for an additional fee.

7. Delivery

Digital galleries are typically delivered within the timeframe discussed during booking. Delivery times may vary during peak seasons.

Final images are delivered through an online gallery unless otherwise agreed.

Clients are responsible for downloading and backing up their images after delivery.

8. Copyright

All photographs remain the copyrighted property of Michael Straub Photography under United States copyright law.

Purchasing photographs does not transfer copyright ownership.

9. Personal Use License

Unless otherwise agreed in writing, clients receive a non-exclusive license to:

  • Download and print their purchased images
  • Share images on personal social media
  • Share images with family and friends

Images may not be:

  • Sold
  • Entered into contests without permission
  • Used commercially
  • Altered beyond normal cropping for social media
  • Edited with filters that significantly change the photographer’s work

Commercial usage requires written licensing.

10. Model Release

Unless otherwise agreed in writing, clients grant Michael Straub Photography permission to use photographs for portfolio display, website galleries, social media, advertising, competitions, studio samples, and promotional materials.

Clients who prefer privacy may request in writing that their images not be used for promotional purposes before the session.

11. Client Responsibilities

Clients are responsible for:

  • Arriving on time
  • Securing any required location permissions
  • Supervising children and pets
  • Informing the photographer of any important family dynamics or requested groupings before the session

Delays caused by the client may reduce shooting time.

12. Venue and Location Restrictions

Michael Straub Photography is not responsible for limitations imposed by venues, parks, resorts, or property owners.

Any permits, admission fees, parking fees, or photography permits required by the location are the client’s responsibility unless otherwise agreed.

13. Equipment Failure and Force Majeure

While every reasonable precaution is taken, Michael Straub Photography is not liable for circumstances beyond reasonable control including:

  • Severe weather
  • Natural disasters
  • Government restrictions
  • Venue closures
  • Equipment failure despite reasonable backup precautions
  • Illness or emergencies

Liability is limited to the amount paid for services not performed.

14. Limitation of Liability

Michael Straub Photography will exercise reasonable professional care in providing photography services.

In no event shall liability exceed the total amount paid by the client for the affected services.

15. Digital File Storage

While Michael Straub Photography makes reasonable efforts to archive delivered images, long-term storage cannot be guaranteed.

Clients are strongly encouraged to maintain multiple backups of all delivered photographs immediately upon receipt.

16. Website Use

Website content, photographs, logos, and text may not be copied, reproduced, or used without written permission.

17. Privacy

Client contact information is used solely for communication, booking, billing, gallery delivery, and related business purposes.

Personal information is never sold to third parties.

18. Governing Law

These Terms of Service shall be governed by the laws of the Commonwealth of Pennsylvania.

19. Changes to These Terms

Michael Straub Photography reserves the right to update these Terms of Service at any time. The most current version will be posted on the business website.

At Michael Straub Photography (“we,” or “us”), we value the privacy of individuals who use our websites and related services (collectively, our “Services”). Events. If you register for an event that we host, whether in-person or online, we may collect relevant information such as your name, address, title, company, phone number, or email address, as well as specific information relevant to the event for which you are registering.

User Content. We may allow you and other Users of our Services to share their own content with others. This may include posts, comments, reviews, or other User-generated content. Unless otherwise noted when creating such content, this information may be shared publicly through our Services.

Payment Information. If you make a purchase through our Services, we (or a third-party payment processor acting on our behalf) may collect your payment-related information, such as credit card or other financial information.

Job Applications. If you apply for a job with us, we may collect relevant information such as your name, phone number, email address, position, job history, education history, references, a cover letter, and other similar information.

Information We Collect Automatically When You Use Our Services

Device Information. We may collect information about the devices and software you use to access our Services, such as your IP address, web browser type, operating system version, device identifiers, and other similar information.

Usage Information. To help us understand how you use our Services and to help us improve them, we may collect data about your interactions with our Services. This includes, but is not limited to, information such as crash reports, session lengths and times, the specific pages and other content you view, and any searches you conduct on our site.

Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. Events. We may share your information with event partners or co-sponsors to facilitate the events for which you register.

Your Choices

Our Communications. From time to time, you may receive marketing or other informational email messages from us. You can unsubscribe from our promotional and informational emails via the link provided in the emails. After opting out of receiving such messages from us, users may continue to receive administrative messages from us that are necessary to service User accounts.

Our Partners. You can learn more about Google’s privacy practices and your options for how they use your information on Google’s website. You can also learn specifically about Facebook’s advertising practices on its website.

Some of our advertising partners may be members of the Network Advertising Initiative or the Digital Advertising Alliance. Security

We make reasonable efforts to protect your information by using administrative, technological, and physical safeguards designed to improve the security of the information we maintain and protect it from accidental loss, unauthorized access or use, or any other inappropriate or unlawful processing. Because no information system can be 100% secure, we cannot guarantee the absolute security of your information.

Children’s Privacy

We do not knowingly collect, maintain, or use information from children under 13 years of age, and no part of our Services are directed toward children. International Visitors

Our Services are hosted in the United States and intended for use by individuals located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with operating the Services and storing or processing data. By using our Services, you consent to the transfer, storage, and processing of your information as described in this Privacy Notice.

We will post any adjustments to the Privacy Notice on this page, and the revised version will be effective when it is posted.
